Of Simple Mercantile Defraudment

of corporal ignominy if applied to such a person
of this description might besides being needless

of it might shock the sentiments of the
people. This however is to be understood only
of persons of like condition: for as to the lower
classes it would probably be satisfactory to them
on account of its seeming impartiality. In It
the second place, it might put too much in the power of the Judge:
to whom the an offender of such consequence might on some private
or party account have become particularly personally
obnoxious. or 3. what is more likely to happen,
the Judge, if there were no medium between so
severe a punishment and absolute impunity,
might be disposed through compassion or favour or timidity to acquit
him the offender altogether. In such an event, the superfluous
part of the punishment would destroy the efficacy of the whole. To p. 11 No 2.
