Torture
This is the most extensive sense I like it
that care be given to the word Torture ; and I have purposely referred
given this account of it in order to comprise as well the cases in which
it is improperly applied, as these if any in which it
might be proper to properly applieyd. it
The arguments that I have seen hitherto
brought against it apply none of them to any
thing but the abuse; they do not therefore necessarily
conclude against the use. they might it
is true if the use abuse were inseparable from the use
but this will be found, I believe, not to be the
case.
Torture being thus explained , it It may do something perhaps towards for removing
the prejudices that are apt to be entertained against it , if it be shewn it can shew
1. That there are cases in which it is customary
to apply it, and in which nobody suspects [the
use of it to to be improper.] it to be wrong.
2. That it is likely or apt to be less penal, in other words that productive
of less hardship upon the whole to the party than other
applications which are commonly employ'd for the
same purposes and with which nobody finds fault to which nobody objects
3. That the very circumstance [that distinguishes it by which alone it
from] from stands distinguished from what is commonly called punishment,
is a circumstance that operates in it's favour.] If & torture
