Of Justifications

Powers — division of.
Evil itself is good in comparison of greater evil.
It is the business therefore of the legislator to
admitt of evil whensoever by that means and not
without that means evils to a greater amount though distant greater evil can be excluded. On He

-cluded He who with the allowance of the legislator
does or might do may produce evil as a means of doing
good to to others is said to possess a power: which
in such case to distinguish it from physical
power is called a legal power: and to distinguish it from the any power which he is indulged with for his own sake merely, is stiled a fiduciary power. Those Powers — unappropriated or appropriated Such powers
may either be given to all persons in general
upon particular occasions; in which case they
may be stiled powers in common or unappropriated occasional powers: or to only to
particular persons only upon all occasions in
which case they may be stiled standing privileged or appropriated powers.
Such powers again as are common or unappropriated
may either be conferred for the sake
of the benefit expected to result from the exercise
of those very powers themselves; or for the and in
this case they may be stiled independent or unsubservient
unapproriated powers; or only for the
