Aggravation
The term aggravation is herein after employed
instead of saying, ground of aggravation.

Ground of Aggravation, what
A ground of aggravation is any circumstance
the existence of which when applied to the
act in question brings it within a case in which
the punishment appointed for the act is or may
be greater than the punishment in ordinary
appointed.

is accordingly to add something or to empower
the Judge to add something in quantity to the
punishment otherwise appointed.

Aggravating Circumstance.
An aggravating circumstance, or circumstance
of aggravation is the same thing
with a ground of aggravation.

An Extra-punishment, what.
Any punishment which is added to
the on account of an aggravation to the ordinary
punishment is termed an extra-punishment.

Extra-punishments Specific and intensitive
Extra-punishments are either specific or intensitive:
specific are those which differ from the
ordinary punishment in kind as well as in degree:
intensitive those which differ in degree only.
