to the thing they may be either disjunctive

The worst time for making a Law against
an offence is the time when the offence by it's either
makes itself known for the first time or happens to make or by some flagrant instance
makes itself particularly conspicuous.
Then it is that men see understand more clearly
the nature of the mischief; or at least are
more particularly sensible of the it's magnitude.
but then it is that the antipathy against it
is apt to be most violent: and is apt by that means
to prompt the legislator to violate the two
great species of proportion in penal arithmetic mensuration
the proportion between the punishment and the
offence to which it is annext, and the proportion
between that punishment and the punishment
of other offences connected with that in question.
Thus it is that laws are the dictates
