Still less is the demand for exceptions presented by the case
of J judications. Framed by lawyers, every where as yet the system of judicial
procedure has had for its object or end in view, in lieu of a universal interest, the advancement of the particular
and thence sinister interest of lawyers — instead of the diminution
of the evils to which the business of judication unavoidably
gives admission, namely, delay, expence, and vexation in other
shapes, the swelling of the mass of these so intimately
interwoven evils abuses for the sake of the profit extractable out of
the expence. It By that same sinister interest what is required
is, that in every question that can arise the uncertainty to which
the delusion appears to be exposed should be such, as by the help
of inflammatory and delusive passions, both parties to the disagreement
should find behold adequate inducements for entering
into and persevering in the disastrous conduct and to
this intent purpose that when if clear of the influence of the role of
deception, the right would appear to every eye appear to be on
one side, by the end of these instruments of deception the chance
of blinding the eyes from the perception of right of turning mens
eyes from the truth of the case may never appear altogether
hopeless.
