part with which punishment had not<lb/>
any thing to do in any shape as that<lb/>
part which prescribed death for punishment.<lb/>
Was it a secret to him that the<lb/>
common sense of mankind rises up<lb/>
now and then in judgement against<lb/>
the iniquity, the eye of the legislator<lb/>
now and then half opened itself for the<lb/>
purpose of looking at and proscribing<lb/>
it and that accordingly in the civil<lb/>
branch it as often received a weak and<lb/>
insufficient check &#x2014; but that the creators<lb/>
and preservers of the corrupt system<lb/>
had influence enough to ward off<lb/>
altogether the application of the remedy<lb/>
from the whole of the criminal branch &#x2014;<lb/>
