<p>My Lords, considering the Number of Years which have <lb/>elapsed since the first Steps were taken, with a View to the <lb/>adoption of any Plan of this Kind, and the Variation of Circumstances <lb/>which have occurred during that Period; the improved State <lb/>of the Colony of New South Wales, as appears by the Enclosure <lb/>transmitted by his Grace in the letter abovementioned, as well <lb/>as the various Improvements which have since taken place <lb/>in the different Gaols in this Kingdom; and the great Increase <lb/>of Terms which M<hi rend="superscript">r</hi> Bentham now proposes; are of Opinion that <lb/>it would not be expedient to carry into Effect this Plan to the <lb/>whole Extent proposed by M<hi rend="superscript">r</hi> Bentham. But they <sic>submitt</sic> to his <lb/>Grace, whether, by way of Experiment, it may be fit to carry it <lb/>into Effect on a more limited Scale, or whether under all the <lb/>Circumstances it may be advisable, at the present Time, to relinquish <lb/>the Plan altogether. Read Letter from Mr King, dated 28th ult. written by Direction
of the Duke of Portland, on the subject of Mr Bentham's Memorial,
respecting the Necessity of an Increase of Charge in the
Terms of his Contract for erecting a Penitentiary House.
My Lords, considering the Number of Years which have
elapsed since the first Steps were taken, with a View to the
adoption of any Plan of this Kind, and the Variation of Circumstances
which have occurred during that Period; the improved State
of the Colony of New South Wales, as appears by the Enclosure
transmitted by his Grace in the letter abovementioned, as well
as the various Improvements which have since taken place
in the different Gaols in this Kingdom; and the great Increase
of Terms which Mr Bentham now proposes; are of Opinion that
it would not be expedient to carry into Effect this Plan to the
whole Extent proposed by Mr Bentham. But they submitt to his
Grace, whether, by way of Experiment, it may be fit to carry it
into Effect on a more limited Scale, or whether under all the
Circumstances it may be advisable, at the present Time, to relinquish
the Plan altogether. In the latter Event, their Lordships
shall feel it incumbent on them to make such Compensation
to Mr Bentham as the Loss he has sustained in preparing
for this Undertaking may appear to them to deserve. —
Acquaint Mr King therewith, for the Information
of the Duke of Portland.
