C Of Punishments In General

General limits of
Pecuniary punishment.
Pecuniary punishment although a particular Sum should
be appointed shall never extend beyond three fourths of a
man's fortune: insomuch that upon giving up the whole
amount of his fortune, he shall always be allowed to
retain one fourth: except where a proportion greater than
three fourths is by law expressly appointed to be taken from him.

Punishment postponed
to
Compensation.
Pecuniary punishment shall in all Cases be postponed
to compensation: insomuch that whatever has been
exacted from a man on the score of punishment shall in
case of deficiency in the offender's effect remain liable
to all claims on the score of Compensation

In aid of pecuniary
punishment comes
Imprisonment.
Whenever a fine is set upon an Offender and there is any
part which he is unable to pay, as to so much, imprisonment
shall be appointed in its stead; and it shall always be declared
in the sentence how much of the fine shall be cancelled.
