It is a fact but too notorious to be dissembled that the state of the
criminal law in this country affords room for very
considerable improvement: the progressive increase in the known
multitude of crimes known to be committed known instances of delinquency, even in
time of war, and the consequent menace in that part
of the pub expense of government which bears immediate
relation to that object, affords the most
convincing proof of it: but so long as no body stands
person in particular stands specially charged with
the task of watching over and observing the demand
of for improvement, and using endeavours for supplying
that demand, it seems difficult to say from whence
any regular and any consistent system of endeavours
uniformly and constantly directed to that object
can be expected to come. The institution of an
Office for this purpose is sanctioned by has the sanction of a recent precedent
in the instance of the naval works department: and instituted
the success benefits which appears appear to have res already
resulted from that institution in the small compass
of two years, appears to add to the authority of
example the testimony of experience. The same
considerations which recommended the institution
of a regular source of improvement in the existing instance
plead in favour of it in the instance here proposed:
in the existing instance indeed, the source of improvement
is constituted by a single Officer, with others
under him:: in the instance here proposed in question it is
proposed to be constituted by a Board: not that
for the single purpose of originating improvements
a Board would be preferable to an individual, but
that a Board being regarded as necessary for the or
proper at least were it only conformity's sake for the
discharge of the judicial and fiscal functions the benefit
of whatever lights may be afforded by the individuals chosen to
