Police Bill Observations §§ 2
It is purely for the advantage of the individual
concerned, and that in a very high degree, for his advantage purely,
and in every point of view that the power of legislation in matters
of this sort should be committed assigned <add> intrusted over exercised to a
subordinate authority, subject of course to the
controul of Parliament, instead of being exercised
by Parliament itself. If Parliament be led
into error, whether by the error or the corruption
of those who have obtained its confidence, there
is no higher legislature authority to correct rectify the error
When the error originates with a subordinate authority,
there is not only Parliament to correct set it to right
it if pure from corrupt corruption motives, but Courts
if tainted with corruption, there are Courts of
Justice to punish it, and in the present instance
the authority of the Superior Office, the Treasury and the
Secretary of State, not only to punish and it and punish any improper exercise of authority in this line, but to stop it prevent it from taking effect.
Possibly, though it would be less methodical
it might be more prudent to postpone the
general clause til after the insertion of the
several particular clauses, which by exhibiting so many
particular instances in which the power in question
may be useful, afford so many exemplifications
of the utility of the power considered
in a general point of view.
