Terms of Book keeping
In the consideration of the means to be employd
for giving efficiency to the system of controul above exhibited There may be a place for stating the considerations
suggesting the expedi which appear to warrant
the powers given to the Board by the following
Sections for making regulations on the subject therein
mentioned. Towards the conclusion of the Bill comes
a clause taken from the Hackney Coach Office Act
for extending the powers of subordinate legislation
given by this Act in the mo respect of that class of
persons to the several other classes proposed to be brought
under controul by the present Bill. But the case
which is the subject of that clause is the case where
neither the persons or classes of persons subject to regulation , nor were the types of regulation are not particularly are not specified, and in that
case the check of a superior authority such as that
from a Chief Judge of the four great Chancellor and the three other Chief Judges may well appear will to be nothing less than necessary. In the following instances the
types are all justified, and in such a case the
power in question will be of regulation without any
such superior check will be found to be amply warranted
by precedent not only by expediency but by
precedent.
In the capital case of Publicans, which is the
case most in point, and in which the species it and
degree of controul established serves as the model of
what is proposed to be done by the present Bill, the
powering discretionary power accompanying the power authority of granting
the licences, supported backed by the recognizance with which is is
made to accompany made a necessary accompaniment to the licence it accompanied has already been
understood to confer a general power of regulation
in a word of legislation, extending over the whole
body of persons licenced: a class more in
this case than all the perhaps the whole number of classes comprised in this present
Bill put together.
