First then it is an evil. And here we may observe
that the sense in which the word punishment is employ'd is properly only
the last or the last but one of those distinguished in the
above specimen. For the evil here meant is only a physical
evil, to wit either a pain of a loss of pleasure, or
also that physical situation or condition of the party affected,
which is the immediate cause of th such pain or loss
of pleasure. As to moral evil the notion of it is as yet too obscure
and unsettled to be admitted into a definition.

Secondly, it is and evil resulting from the intention of
some person: if it results not from the intention of some
person it is a calamity not a punishment. It is no
punishment if it result either solely from the sole agency either of a being
not susceptible of intention such of a portion of inanimate
matter such as a stonesword falling to the groundfrom the cieling, or
of a being susceptible of intention, but not directing it to
the production of the evil; such as a man who should
give motion to a sword without supposing any person
to be in the way of being hurt by it.

Thirdly, it is an evil resulting from the direct+ intention
of some person. It is not a punishment,for if it be obliquely intentional
