1826. April 24.
Penal Code
Ch.2. Offences affectg. person
§.1. Simple corporal vexation
Exposition or Expositive
Act 3. Of modes of producing corporal
vexation, over and above those already referred to,
examples (a) here follow. But note that they are
but examples. For, so as bodily pain or uneasiness
to a material amount is but produced, and
produced by an act accompanied with the design
of producing it, whether singly and to the exclusion
of other such effects, or undiscriminately undiscriminatingly, in conjunction
with a chance of producing either one or
more of such effects, it matters not in what
shape or by what means, the corporal vexation -
the bodily suffering - is produced.
☞ Here insert some examples from the Books,
having ranged them under heads.
(a.) Examples
1. Offences annoying to the ear. Noises produced so loud
as to produce by their loudness a sensation of uneasiness
in the organ of hearing.
2. Offence annoying to the taste. By physical force,
intimidation, or deceptions practice, the wrongee
induced to swallow, or take into his mouth, a
nauseous or corrosive liquid.
3. Offences annoying to the smell. By like practice,
fetid matter applied to the organ of smell.
