These<lb/>Gentlemen, both of them <hi rend="underline">Magistrates</hi>, and in that quality —<lb/><hi rend="underline">Managers</hi>, each of them of a Prison: the two <hi rend="underline">only</hi> other —<lb/>persons examined being <hi rend="underline">Head Jailors</hi>: viz <hi rend="underline"><sic>Mr</sic> Newman</hi> of<lb/><hi rend="underline">Newgate</hi>, <sic>Mr</sic> <hi rend="underline">Ives</hi> of the <hi rend="underline">Horsemonger Lane</hi> Prison; each of<lb/>these <add>two</add> examined as to discipline only, and not as to —<lb/>economy.</p> <p>Of the two <hi rend="underline">Magistrates</hi>, one, viz. <sic>M<hi rend="superscript">r</hi></sic> Beecher, was (I<lb/>understand) upon or soon after the passing of the Act, —<lb/>appointed under and by virtue of the Act, one of the three —<lb/><hi rend="underline">Superintendents</hi> for the erection of the <hi rend="underline">now</hi> intended Penitentiary —<lb/>House, to be built on the Ground, taken out of my hands, as<lb/>above.</p> <p>II <hi rend="underline">For the Claimant</hi>. §.7. Rates of profit in pari materia.
1 In regard to the opinion of Sir George Paul, it is a naked
opinion, unsupported by any accounts: although they only prison,
of and from the Accounts of which that Gentleman could
have been speaking , was then, as for many years it had been, under
his management.
Answer. It is one of the two only Documents, on —
the ground of which, so far as concerns economy, the —
Penitentiary Committee, y which, in the setting aside the —
Claimants Plan for such Causes and on such —
Grounds, as may be seen in the Report x x Penitentiary
Committee Report 31st
May 1811. acted: the —
Evidence of Mr Beecher above mentioned being the other. These
Gentlemen, both of them Magistrates, and in that quality —
Managers, each of them of a Prison: the two only other —
persons examined being Head Jailors: viz Mr Newman of
Newgate, Mr Ives of the Horsemonger Lane Prison; each of
these two examined as to discipline only, and not as to —
economy.
Of the two Magistrates, one, viz. Mr Beecher, was (I
understand) upon or soon after the passing of the Act, —

II For the Claimant. In this direction will be found

As to the 5th Rate, viz: Southwell Rate for 2 years
ending 25th Decr 1810.
In relation to this 5th rate of profit, being the —
first of the two deduced from the Evidence of the —
said Reverend Mr Beecher. Observations to some
such effect as the following may perhaps present —
themselves.
