Survivants to the right of compensation for
the benefit of the representatives of the wrongee.
As to this point a rule scarcely to be watched
for the flagrancy of its injustice and mischeviousness
is to be found, in any sistem of law,
even in the English system itself. For injustice
in the shape of delay inaction and
factitious expense, practiced after suit commenced
and thence, for the original injustice,
in a shape in which it is the cause
pf suit, a premium is held out, and the
offer of it is made co-extensive with the
whole of the field occupied by a civil action, action
with this it so indefatigably boasted mode of trial. The
more cruelly and perseveringly you wrong after the suit commenced.
The party whom before such commencement
you had in contemplation of
this means of security for your injustice,
marked out as the intended victim of your
fear of depredation or oppression, the greater
is the promise of success you are thus allowed
to give yourself. Miserable his case: fortunate
or well-chosen yours, the nearer
he is to his last moments, whether by
bodily affliction, by mental affliction or old
age.
