Mutilation

Mutilation, what
By Mutilation I mean the extirpation of any
conspicuous part of the human body that is endured with
separate motions or specific functions.

it may be performed
The Members liable to be extirpated without
the loss of life are as follows

1. The Eyes.

2. The Tongue.

3. The Hands; and in general any portion
of the upper extremities amounting to a
joint; but with this obvious condition, that
whatever is below the joint meant to be taken
off must be taken off to along with
it.

4. The Feet, and in general any portion
of the lower extremities amounting to
a joint

5. The Pudenda.

– why not on others
Of the other parts that have been mentioned
as being liable to Disablement, the
organs of smell taste and hearing are either
not capable of being extirpated, or if they are, the extirpation
of them is not to be considered as amounting
to Mutilation: since they are not
conspicuous. The Mouth and Anus are not
capable of being extirpated being but cavities,
not portions of substance. The under Jaw,
and vertebrae of the neck are not capable of
