Art. 41. And whereas the several negotiations
and contests as aforesaid, in all which one
and the same individual will have to deal with
numerous and opulent bodies, cannot in all
probability but be productive not only of much
unavoidable trouble to the said such individuals but
also of very considerable and in great measure
unavoidable expense And whereas although by
the Statute of the fifth year of King George 2d
Chapter 19th after reciting that ⊞ ⊞ great expenses had in divers instances been occasioned by reason that upon exceptions
touching the form of proceedings before Courts of Justices
Sessions such proceedings and have frequently by Courts of Sessions
set and without any examination into the truth
and merits of the case been frequently set aside
and that as also judgments and orders of Justices had
in divers instances been removed into the King's
Bench in hopes to weary out parties by such expenses
and delays and expenses it is provided that defects
in point of form found in Judgments and
Orders of Justices should in the respective Courts of
Sessions be rectified without charge, and the truth
and merits be thereupon commenced into considered and witnesses
examined, and all other proofs heard, and
such determination made as if no such want of
form had been found, but yet And Whereas not withstanding by reason that
