<p><del>3.</del>II.  Now as to offences by which person<lb/>
and reputation are affected at the same time.<lb/>
In this case, the connection is not, as in the other<lb/>
case natural and universal.  It depends upon<lb/>
a peculiar turn taken by the moral sanction, &amp;<lb/>
the public opinion Tribunal in a certain class<lb/>
of nations.  This opinion is so far connected with<lb/>
civilization, <del>where</del> <add>that</add> it is only in nations arrived<lb/>
at the highest as yet known class of civilization<lb/>
that it has place:  <del>whi</del> but it is only by accident<lb/>
that it is connected with civilization:  for in a<lb/>
still higher stage of civilization it will have vanished.  In this place, two intimations conceived<lb/>
for the present in the most general terms, may<lb/>
have their use:  to wit.  1.  That it is in the feudal<lb/>
system that it lost it's rise:  that it is to the imperfection of the state of the law, to wit of the penal<lb/>
Code and the Procedure Code thereto belonging,<lb/>
that it owes its continuance.</p>
<p>By a strange perversion of reason, in certain<lb/>
cases where corporal vexation has been<lb/>
produced, on the correspondent attempt <del>for</del> <add>or</add> preparation<lb/>
manifested, <del>public</del> the disapprobation<lb/>
entertained and manifested by public opinion<lb/>
directs itself – not against the author of the wrong,<lb/>
but against the sufferer by it:  in which case, the<lb/>
public opinion Tribunal, instead of exercising one<lb/>
wrong, as in most other cases a expressive, exercises<lb/>
a productive or promotive force, operates as<lb/>
a blind instrument in the hand of the wrong doer,<lb/>
and <del>inflicts</del> <add>adds</add> to the corporal suffering produced by<lb/>
him a mental suffering, which of himself he never<lb/>
could have produced, nor in short any other agent other<lb/>
than itself.</p>
