Capital Punishment.
Of all all the possible various punishments of the corporal
kind to which human nature is liable, the only
one now remaining to be considered is that which is
commonly called Capital Punishment; the punishment
of Death.
Capital punishment may be distinguished into 1st
simple: 2dly afflictive.
I call it simple when no
bodily more if any a bodily pain be produced, more however no greater degree of it
s produced than what appears (inseparable from the
process of putting an end to life) necessary to produce
the effect of Death.
I call it afflictive when any
degree of pain is produced more than what is may be necessary
for that purpose.
I call it afflictive when it is attended with any degree
of pain more than what is necessary: simple when
it is not.
Now then, when it is afflictive, it is evidently a complex
punishment. It is capable of being resolved into
two distinct punishments: simple afflictive Punishment, and Capital. These, it is manifest, are each capable of being produced
without the other. Simple Afflictive Death is consists
therefore consists properly speaking of two punishments. What
makes them show be looked upon as one is that they are capable
of being produced together: to wit by one and the same operation.
Of these two punishments, the one has already been considered.
