Punishments Succedaneous
This circumstances makes it a matter to be settled, 1st of what
proportion species the the succedaneous punishment ought to for tobe 2dly what
proportion it ought to bear to the primary. This is what I shall now proceed to examine.
In what quantity.
The failure of the primary punishment it is to be observed we have
may arise from either of two causes. 1st From the
want of power to bear it; or 2. from the want of will.
When the power is the cause [of failure], the proportion
is soon settled. There is no reason why the succedaneous
punishment should be either greater nor or less than the
primary; therefore it should be equal. The business then
is to determine what quantity of the first former shall
be deemed equal to a given quantity of the latter
and so through every & assignable degree.]
As to the species – it ought to be this will be determined
by the properties it ought to have in
order to enable it to take the place of that to
which it is substituted. It ought therefore 1st In some cases to be
temporary chronical: 2dly in all cases to be variable in degrees.
