Evidence
This case is would be found comparatively an uncommon
one: but in the opposite case which is the most common, so
sure as it is is it that there will be one of two parties whose interest
it is that the truth should be brought to light, and in its genuine
colours and whose exertions efforts endeavours will be bent to the bringing it
to light in those same colours, so sure is it that there is
one other another party at least whose exertions will be employed at any rate in
the preventing it from coming to light or and rather perhaps rather than that it
should come to light in its genuine colours smothering concealing it under
a covering a load of false and delusive evidence. What is worse,
in by far the most common state of things that occurrs, the interest
by which the one of two parties a man one party is prompted either to keep suppress the true evidence
or conceal it by a covering of false, is greater more impressive than the interest
by which a man the other party is prompted urged to bring forward the true
and to the in case of false evidence to detect the false. expose the falsity of it. In
the case all cases between belonging to the penal branch the truth of
the observation is seen at once: in the non-penal branch it
will be seen a glance equally rapid will suffice be sufficient to shew
it to be the predominant case inasmuch so far at least as the burthen attached
to obligation fulfilment of the obligation by which the
right attendant on the inseparable from the collation of the right
demanded is attended with the sensation of a loss.
