§. 1. Wrongful non collation

Wrongful Non-Collation of Guardianship, is

The person by In this case as in that of Mastership
the person by whom this offence is committible are all any
persons to whose in through delinquency a person of within age
immature in age fails of having for his Guardian
a person who even but for di according to law ought to have
should in relation to him have stood in the condition
of Guardian, and, but for such delinquency with or
without corresponding concurrent delinquency on the part of some other
person or persons, would have stood in such condition
accordingly.

Persons liable to stand charged with delinquency in
this shape are

Persons who on this occasion bore or ought to have
borne a part in Judicature the administration of Justice.

2. On the part of the Father himself the performance of
this function is naturally optional: the omission accordingly
not capable of being considered in the character of
an offence. But suppose that by appointment of law
upon a persons having accepted from at the hands of
a Father the condition of Guardian in relation to his
child it is has been made the duty of such Guardian
in such or such an event for example by ill health or his being what
rendered or about to be rendered incapable of exercising
those functions in person, to appoint some person to officiate act
sharing the minority in question, or for a limited time in his stead:
and that being thus subject
to this obligation,
he has omitted to fulfil
it: in this case, such
non fulfilment will be
an offence, and such as above, the description of it.
