§. 3. Immediate or preparatory

Art. As with regard to every other judicial operator so with regard to those by what execution is given to a decree of a judge.
In the ordinary state of things, and in so
far as the nature of the case is understood, those many
which are regarded as necessary to justification of will
be necessary to execution. For to act without evidence is to
act arbitrarily and unjustly – and to act without sufficient
evidence is to act either immorally – uneasily or immorally
and and in the ordinary state of things, as in that any other official situation, as in that of a Judge
in no one of these ways will a Judge it be the decree agreeable to
a Judge man to be seen to act. But of this deficiency in morality
or wisdom examples are but too few great extent will soon
be brought to view visible.

Art. As to of evidence and means of probate,
the arrangements that which under this head present themselves as most
conducive to the ends of justice will in an appropriate chapter
be presently brought to view in an appropriate Chapter.
