But of this supposed and imaginary article of
Statute law the efficiency in respect of the prevention
of peace, in respect of the continuance of war for
and during the term aforesaid the far short indeed does
the efficiency fall short of the efficiency with which
the article of unwritten alias Common law which
actually being enacted established by the nature of the case actually
have place and is in force, tends to the production of
the that same result.

Of the supposed article of sta written law the
efficiency would depend upon all the several contingencies
and defeasances upon which the efficiency of every article
of positive written law and in particular more particularly of every article of penal
law has been made to depend, referred for execution
to any an ordinary court of regular procedure such as the
King's Bench, it would depend not only upon the existence of
sufficient evidence but upon that application
or non-application of this or that one of those rules by or pair of conflicting rules in
virtue of which evidence may be either admitted or excluded,
compelled or left uncompellable: it would depend
depend upon the application or non-application of
this or that one of those rules of nullification by which
the execution or non-execution of every law and
more especially of every penal law is placed at the rendered subject
to the will disposal of each one of a variety of different hands
official or professional, to whom it belongs to make
or to avoid making of any one of those mistakes or errors or supposed supposed mistakes to which that effect has been attributed attached
by judicial probity and evidence: it would depend –
but in short there is no end of who shall look upon him to assign the end of the list of the contingencies on which it would depend?
