§. 29 Judicatories for Accounts-taking and Claim receiving Judicatories

Instructions to the Legislator

In §. 1 Under the head of Exception judicatories reference
may be seen made to this Section for certain species
of cases which will may naturally appear to create a
demand for particular sort of judicatory, acting by
a particular set of rules, but which which demand however will on examination
will be found not to do its have place. These are those which follow the cases, of which in
cognizance has in practice been taken by common practice cognizance has been given to two sorts of special judicatories
distinguished under the name of Accountability and Claim Receiving
Judicatories the name of Account-taking and Audit Courts and Courts of claims: Audit Courts that is to say Account-taking, Courts of Claims that is to say Claim-receiving
Judicatories. In relation to these what will be
seen is that the is compared with other cases
these do in truth present a demand for variation,
but that the variation consists – not in the composition
of the judicatory, nor yet in the source of shape nor in the mode of proceeding in any respect
the evidence or in the shape in which it should
be required or admitted to be presented, but merely
in the situation of the locator: of the functionary by
whom they occupied in this case or the business
of judicature is located. In all other of cases the
situation of the functionary by whom in case of demand
for extra supply of judicial labour, the supply is furnished
