Inconsiderable is would be found to be the mass of the evil produced by this indirect
power under Rome-bred law in comparison of what it is under
English-bred law in English practice. In addition to the public
functionary locater of the Monarch – the public functionary to whom
the power is given avowedly, openly and in the direct way
many are the individuals to whom unavowedly and secretly
it is given here by the practice of Judges been given in the an indirect
way. Who they are and accordingly in what a number are points
which to an individual eye are to an indefinite extent invisible:
sooner or later the constituted authority will feel the
necessity of rendering them compleatly visible.

Of these secretly acting Monarchs the general description
is this – all persons by of whose omission non-feasance or
misfeasance in respect of duly remission of punishment has
been made the a consequence. Lawyers in every case, in some
cases official, in other cases professional, in other cases again
those of both classes.

The Class of persons by whom this monstrous system
of iniquity has been organized, the superior Judges, the Judges highest class
of Judges. , the sinister profit reaped by them from two sources.

1. By the uncertainty thus given to punishment, encouragement
given to criminality in the correspondent shapes, multiplication augmentation
to the number of individual instances of criminality, thence
to the number of prosecutions from all which, in an a direct
or indirect way or both these same high functionaries have not in
all times given to themselves a profit.

2. In so far as the persons by in whom this virtual power of pardon has thus been
conferred have been the subordinates and traitors of those
same Judges, a further profit has been derived by them in this two
other shape shapes. 1. By the hands of those sham creatures and instruments
they have enabled themselves to give or sell impunity in this or that
character occasion for those each Judge for his very particular purpose
and profit from. 2. by in respect of and in proportion to whatsoever profit has been derived taken by these
their locaters, a correspondent
profit has of course, and in
the nature of the case found
its way into the pockets of the
patrons.
