this tendency may be reckoned <add>placed to the account of</add> among the advantages of Jury<lb/>
trial.  But were it was to come to be received in the<lb/>
character of a principle, and to speak <add>operating</add> with such force as<lb/>
to engage them and that notoriously to give a verdict<lb/>
in favour of the weaker party, in a case clear of doubt,<lb/>
and against the known justice of the case, this tendency in<lb/>
proportion to its force, would operate in diminution of the advantage<lb/>
attended to this mode of judicature.  A case though<lb/>
not likely to be exemplified may without any difficulty be<lb/>
conceived, in which the disadvantage <add>mischief</add> from this source might<lb/>
swell to such a pitch as to outweigh the advantage altogether.<lb/>
For carry it to a certain pitch, it becomes a levelling principle;<lb/>
and by laying the axe to the root of all property,<lb/>
dooms <del>political</del> <add><gap/> to extirpation</add> civilized society itself to extirpation.</p>
<p>In this <add>ideal</add> case the mischief <del>of misdecision in the matter of<lb/>
such would be still greater than that</del> would exceed the mischief of <add>as confirmed of</add> misdecision on the <del>matter of</del> part of a permanent<lb/>
Judge in the matter of law in a still higher degree than that<lb/>
exceeds the ordinary amount of the mischief of misdecision in<lb/>
the matter of fact.  The <del>bad</del> <add>unjust</add> judge displaced by death or<lb/>
<del><gap/></del> deprivation, then ends <add>in the bosom of the public</add> the pain of apprehension of which<lb/>
