In the word Guilty, as often as to serve in the character
of a decision, it is pronounced by any man or set of men
acting in the station of a Judge, a decision on both these
points is necessarily and ex vi termini involved: it includes
them both, or it neither includes nor means any thing.
No verdict therefore expressed by the word guilty was
ever delivered by a Jury, without comprehending both those
points. So long as Jury trial has been known, so long
have Juries been known to give verdicts, to pronounce
decisions, expressed by that single but comprehensive
word. And with this before their eyes English Judges
have not till the matter was settled by a modern Statute, have never ceased to contin declare that the jurisdiction of
a Jury does not comprehend include the matter of law, but is confined
to the matter of fact and does not include comprehend the
matter of law!
