Fulfill his engagements – What? every engagement without
exception? every engagement which it is possible for
man to enter into? No certainly some exceptions then may
be

Suppose a number of acts which whether distinguished
or no by any express description given of them By in a determinate
assemblage of words by the legislator, the Judge is in the habit
of treating as acts of transgression/delinquency – an offences
crimes: applying punishment accordingly to all such as are have been
found proved to have committed them. A man enters into an engagement
for performing one act covering the description of one or
another of those acts: ought he be an engagement of this
sort ought a man to fulfill it? does require this? ought the legislator
to compell him to fulfill it? to punish him in the case of his
not fulfilling it?

But in different countries, the different circumstances
of those countries require, the dictates of utility different in
the several different countries - require different species of acts to be
inserted in the catalogue of offences.

Thus then to the rule commanding the fulfilment of engagements
the dictates of utility require different exceptions to be
made in different countries: – the dictates of utility, and surely
the dictates of justice.
