Procedure

The disfavour with which the cause of the

Plaintiff as such is apt to be regarded in comparison
with that of the Defendant is one of the most
flagrant and one of the most pernicious of
articles in the catalogue of vulgar errors.

In point of reason the presumption, the general the probability of right is
now abstracted supposing from the particular circumstances
of each individual case unknown, is many, very many
times to one in favour of the Plaintiff's side.
The In a thousand instances cases the Defendant,
though he knows himself to be in the wrong,
will defend himself in all those cases: whether he be in the right
or whether he be in the wrong, it is equally
his interest so to do so to do, or at least equally likely
to appear at the moment to be his interest
which comes to the same thing. The Defendant's
even by standing a suit gives therefore no sort of reason
for presuming him to be in the right.

It is not The cases in which it can be
or so much as appear to be the Plaintiff's
interest to put himself into the hands of
justice, knowing himself not to have right on
his side are very few and very rare.
