§. 1 Term of Service
Instructional

☞ The order of the matters being determined by the already printed

Instructional.

Art. 1. In addition to Judge Deputes permanent, as
per Ch. XIV., to what end give to the every Immediate Judge principal,
the power of locating an additional set of Judge Deputes
under the name of Judge Deputes occasional?

Answer. To In case of extraordinary demand
for functionary's time occupied in the exercise of the judicial function,
the purpose is to afford an additional supply of Judge
power
, and thereby prevent the existence of the delay
which would otherwise have place. Of the fit person who will
naturally speaking be likely to be disposed to accept of the
situation of Judge Depute the number has been seen to be
limited: by namely by the consideration on that occasion
brought to view: which number will be correspondent
to the nature and number of the Suits, to which in the Judge-shire
in question and in the ordinary state of things, never
for a constancy it will within each given extent of time – say a year – a half year – a quarter of a year happen to be within such given instituted. Of the institution of this additional class
of Judge Depute under the name of the Judge Depute occasional
the object is – to give hearing within each any extent of time commencement and termination to a number
of suits for the giving hearing commencement and termination of which within
that same extent of time the then existing number of Judge
Deputes permanent with the substitution would not have sufficient
would that is to say either of itself, or with the addition
of such fit Deputes, permanent one or more, as within that
same extent of time, would, as above, be likely to be procurable.
