Constitutional Code. Ch. IX. §. 17 Supplement

Art. When a For a pension of retreat, the
only reason or so much as pretence capable of being found
for it is inaptitude for service. But instances have just
been exhibited in which in addition to those several pensions
of retreat granted on the resignation of so many different
official situations, the functionary is in the occupation
of another a fourth office in which he is rendering or pretending
to render official service. Morn Chron 26 Sept, 1826.
Here then. If the entry system
is an abuse another abuse may here be seen here is an abuse mounted upon it.

It does not follow that because in the ordinary case income granted
upon this ground ought to be continued, encrease thus ob
granted on false pretences, by a fraud upon the state, should
receive the same indulgence. But while, after repeated charges printed published in not by anonymous only but well known author the Judges of
a Judicatory at holding in its hands for the purpose
of plunderage six property to the amount of six
and thirty million have confessed by persevering silence the habit habitual practice
of extorting money upon false pretences from individuals,
who can expect that by any such sentiment as shame
functionaries in other any situation should be restrained from the
obtaining extracting by false pretences money out of the public
purse?

If under English government justice were anything like
them an empty name, not the receivers but the granters of
the matter of this plunderage would be made to refund the
whole amount of it with interest, and congratulate with themselves
that on their impunity: the burthen of simple compensation has not having been added to
by punishment.
