Procedure Code

Art. Reference being made to the defendant, execution
may be performed either without compliance, or with and
by compliance: in some cases it compliance will not in most
it will be necessary. On the part of some person or other
it can not but be necessary: for example to vest some person or persons in the chamber of a judicial
functionary. But in some cases, among of the number the persons
on whose part compliance is necessary that the defendant should be one, it is not necessary
that the Defendant should be one: for instance
when to produce the effect of execution, operation upon
things or upon persons other than the Defendant, is
sufficient.
