Grounds of extenuation

In the case of these several proposed
efficient causes of extenuation the pound
is little less obvious and the propriety of
giving to the circumstance this effect
little less dubious. First 1, as to the evil
of the first order, true it is that, in this
case, it has not any such compensation
as in the case of the several efficient causes
of justification.

2. As to the evil of the second order
this, it is evident is not altogether absent
as in the case of an efficient cause of justification. It is present in every case
in some degree, but in most of the cases
if not in every one of them, variable upon
an indefinitely extending scale.

As to means of repression
wronger
may be made compensationally
responsible

In regard to means of repression the
effect appears to be, that, in every case, p compensational
responsibility may be made to attach
upon the wronger the amount of the compensation
money, varying in this as in
all other cases according to a variety of circumstances.
