§. Enactment – forms of
☞ Give account of the different forms of enactment in use

I. For prohibition
1. If hypothetical. If any person shall do so and
so, therefore comes the penalty.
2. Categorical – No person shall do so and so.

Intended subject matter of the prohibition may be
1. individual, 2. aggregates; 3. individuals and aggregates

Subject matters may be 1. Persons considered as
agents: 2. persons or things considered as patients, or
otherwise than as agents.

In the hypothetical form Persons may be made subject matter of prohibition
in the character of agents, by being expressed in the singular.
Example. If any person shall do so and so, he
shall suffer so and so. In this case there can be no
use in adding the plural to the singular: as for instance
in saying if any person or persons: unless the intention
be to include in the prohibition persons taken acting singly
and persons acting in the aggregate.

☞ Look out for a case in which in a hypothetically expressed prohibition the consequence of
the appellation of the subject matter whether agent or personal
in the plural number is that, taken individually,
they will not be included in the prohibition
the prohibition applies to collections of persons only.
