To offences affecting and respecting person personal properly
and reputation, and person and property respectively all
offences affecting and respecting miscellaneous and detached
rights, offences respecting miscellaneous and detached
persons and offences respecting miscellaneous and detached
burdens.

Thus far the two parties the wrongor and wrongee
appear each in that his own character and not in that
of the other. Thus far the case is comparatively simple:
no mutuality, no reciprocity having place.

Remains now the case, in which mutuality
and reciprocity have place, two parties parties are brought
to view between whom, a legal relationship arising
in some instances out of the correspondent natural relationship
has place. In some of the cases the legal
relationship has for its object the benefit of both parties;
in others that of one alone: In virtue of such
their relationship naturally and generally, though
not necessarily so long as the relationship subsists,
they pass a great part of their lives in each others
presence: so many as there are modes of this relationship
so many are the different conditions in
life – such is the common and indeed the only phrase,
which have place between the parties and by the legislator
of necessity taken for the subject of a variety of
arrangements.
