1823. Octr. 23
Constitutional Code. 2. Enactive Part
Ch. Judicially collectively
§ Explanatory Observations

29
For avoidance of
need less vexation
let it be provided
that it such evil fall always
on its author

To those whose ddesire it were to prevent needless vexation the
means of accomplishing it are sufficiently obvious in every instance
in as far as possible let the evil author of the evil proceeding evil be the individual
in whom the evil of it falls If it be for want of this attention
that the vexation has been produced make the author writer responsible,
impose on him in so far as he is able to him at the burthen
if indemnissable of making compensation to the suffering party for the
for the suffering he has sustained suffering to the suffering: if it be not for want of interest, but on
the contrary by reason of attention in of attention employed on
the endeavour to produce the evil and without any justification
causes for doing so render him penalty responsible: to the
burthen of comparative of imposed, add ulterior suffering in the
name and for the purpose of punishment: if either the case does
not admitt of comparative in whom there is no individual
special suffering, or the poor wrongdoer the author of the vexation
how not wherewith to make compensation, in the case to the less of so
much as it would have been necessary to disburse in order
to the purpose of making compensation, substitute equal equivalent
suffering in the name of punishment: in a word word
for simple poverty unconsciousness impose the burthen of compensation;
for evil consciousness, add punishment.

30
This course would
have answered the
purposes of justice
- but not that of
the authors of the
established system.

A course of the sort would have answered to purpose
of justice: but it would not have answered the purposes –
it would not have favoured the sinister interest of the author
or of any of the authors of any established system of judication
In the case in question that interest required
