§. 7, Functions common to all Judges
Art. 1. Executive function. To the exercise of this all-
embracing function the several other functions are contributory
and subservient. To the Judge, it belongs in each Judicatory, within
the field of his authority jurisdiction, to give eff execution and
effect to the ordinances of the Legislature, in so far as contestation
has place either as to the question of law, or as to the
question of fact: as per Ch. IV. Art. 8.
Art. 2. So, to rules of conjectural law, alias Jurisprudential,
alias Judge-made, alias Unwritten, alias
Common Law, so long and in so far as any part of the rule
of action and basis of judicature has been left still afloat
under floating upon that imaginary and essentially precarious nebulous ground.
Art. 3. As to all ministerial subordinates in his own line
and grade it belongs to every Judge, under subject to the direction
of the Justice Minister, to exercise the locative, suppletive
and directive and dislocative functions; as to his own office the suppletive: as to certain things, the
use of which is necessary to the exercise of his other functions
the custoditive and applicative functions: as
to these same persons and things the inspective function; as to these
same persons and things, as well as judicial proceedings
and other occurrences, the statistic and recordative functions; by to
wit by the instrumentality of the respective Registr Registrar of his Judicatory: as
to status of things, ordinances and arrangements, the inclination-
suggestive.
