Even without looking to the tenor of the treaty, your
Lordships will stand aa equally engaged will find yourselves to stand sufficiently engaged by the words
of the Act, when explained by the nature of the case.
By The words of the Act require your Lordships are
required to make choice of a spot for the purpose of
and by the words of the Act, when
the nature of the transaction comes to be considered, your
Memorialist has a necessary negative, as your Lordships
will find, upon any other choice. An option
is given to your Lordships between the spot in
question and what other? – not any other whatsoever;
but any other which shall be as convenient
and proper. As to the word proper it seems to have reference principally and if not
exclusively to the public service. But to be as
convenient the new spot must be equally as convenient
as the old one to all parties: as the old one: it must be con
as convenient not only to the public which is one party,
and but to your Memorialist who is alone is and was intended for looked to as the
other. But no other spot equally convenient to
your Memorialist is to be found had under the Act.
