though knowledge and prudence are both of them good things,
they are by no means altogether the same good thing.
As to universal it speaks for itself: and like as at
once we look at once to all the nations of the earth.
Now then in relation to law what is there that is common
to all nations? the arrangements? the ordinances? the enactments? Alas,
not among the nations there but too many which have no
enactments at all: and did it but depend upon learned gentlemen
this of course would throughout be in that same case: and
among those who have enactments, ordinances, enactments statute
regulation – call them what you will, scarcely could
any one be found which in its exact import is common to all nations.
In relation to law. Of the matter of which law is
made, what then is there that is common to all nations?
What but the ideas, certain of the ideas of which it is composed
of: the s ideas, and of the representations of which, that is to
say the words which are the employed or signs of them those enactments
are in a proportion more or less considerable composed. In
speaking of that which there is that is thus common to all
nations, we may as above, say the ideas: what we can not
with exact truth perfect correctness say is the words: but as this in the different
nations we take language of one nation there are words by which
are expressed ideas which are expressed by the other words or
even in some instances by the same words, in another, without any
difference, if any except
in the pronunciation or spelling
thus far, and in this
sense, it may be said we may say
that in and of the language
of law, there is a portion which is common to all nations.
