Prize 1805. 1809: 1805 § 89

Act 1805. Section 89.

Of this Section which seems very well intended meant,
the object is as in other places to secure the proceeds of a prize with
as little delay and consequently with as little loss as
possible, as likewise so far as accumulation during delay,
is to be placed to the account of profit, with profit
for the benefit of the Captors: the money to be to
be lodged in the Bank in which case of course it yields no
interest or else in Exchequer Bills in which case it
of course does yield interest.

The service proposed to be done undoubtedly a real
one: but what the cases are description is of the case in which it is proposed to
cause it to be done, on this point there lies the difficulty.

1. Of the case in which it is desired that the service
be rendered, rendered by the Greenwich Treasurer, the following
is the description is on the terms following, viz. "Every case in which any
".... Vessel, having made any capture, shall not be
"in any of the British or Irish or North Seas at the regular
"time of distribution, so as to enable the Officers and those
"thereof to be able to receive the same", the same meaning
probably not the Seas the mean nor yet the captain but the money from it which however has not as yet been mentioned.

2. The case thus described – in this case "it shall
"be lawful" (it is said) for the Treasurer of the said Hospital
or his Deputy or Deputies, to cause the proceeds of such
captors to be paid to him or them. within one
month after the regular period of
