1
Ch. All important arrangements
(1 § Communication
1
Communication what
1. Communication. The By this name appellation is designed
an operation which bears reference to all those others, in a
necessary connection to all the others, and of which on this account
no mention could have been made till those others
had been brought to view
2
Communication a necessary
means for all the ends
of procedure
They beg so many distinguishable ends,
it is with reference to every one of them it is a necessary means
Communication for the purpose of application and judicature;
communication for the purpose of private communication for
the purpose.
3
Securing the performance
necessary throughout
the operation of judicature
Not to secure it from the very value of the suit to To result securing the performance of it
the very last act on it on each and every occasion and as between
whatever persons and things the existence of it is necessary to the
attainment of the ends of justice, is a flagrant oversight viz.
would if heedlessness were had been to secure have been a flagrant
oversight. But who it should it be seen that for this omission the result of of old
or has at all times flowed at the offer of those
in whose hand the power was of providing providing the def'ding
is it to any such course as oversight that certainly
with the most ordinary degree manner of discernment that it can be
ascribed.
4
In Bonaparte's Code
flagrant omission as
to this operation
(The text says the reverse
of Donne)
In Bonaparte's Code no such flagrant omission has place.
Not that the means provided are in so perfect a degree as
they might have been adequate to the
evade the attainment of it no such inconsiderable advance is then have they
here made
Being the earliest and most anxious cases of the system
to which expression is given in the Code and those connected with
it is to secure from first to last the existence and efficiency
of an instrument so indispensable to the work of justice.
