Art. Although by the present supposition the a
Suit may and does and is accordingly supposed to have received
its promotion in the course of the same hearing as that
in which it was commenced in which case what is done on
the defendants side will heave to be entered in the record as
well as what is done on the part of the pursuers side.
Yet on this occasion for greater distinctness, it may be better advisable
not to exhibit any thing of what is done will or may have required
to be done on the defendant's side: reserving that for the case
which will manifestly be by most the now ordinary case,
