Most Abridged Petition
That in all cases the system of procedure employed to the
summary: that is to say that which is employed by Justices of the
Peace when acting singly: with such additional times as may be necessary for obtainment
of evidence, and giving execution and effect to orders and decrees.
That for carrying on the system of procedure a new
judicial establishment be : number of immediate judicatories
such that allowing six hours for sittings every grown person
in good health may attend during each sitting without sleeping
elsewhere than at home: extreme distance of home from Justice-Chambers
be 11 or 12 miles
That as in Equity in each Judicatory there be but
one single Judge.
That exceptions excepted this Judge be competent to
hear and determine on all sorts of cases.
That the exception be judicatories for the maintenance
of discipline on the part of Military functionaries by land and Sea,
and Ecclesiastical functionaries.
That the Judge be interdicted from the services of all
functions but the judicial.
That the remuneration of the Judge to wit of all judiciary
officers whatsoever be the whole of it in the shape of salary, and no
other.
That every Judge and other Judicial Officer so remunerated be under the
obligation of providing Deputies, one or more than one by each of whom
all powers exercised by him may be exercised: and when set
remuneration shall consist in the expectation of succeeding, exclusively in vacancies
to the office of the principal, each in cases of need
constituting a separate particular in case of need so many separate judicatories as sitting all the same time.
Thus That, like in Justices of the Peace an authorized
and accustomed, these Judges with the help of their Deputies be obliged
so to order matters that upon occasion the business of
judicature may be carried on every day in the year, and every
hour in the twenty four.
