Supplement
2 II. Elucidations
§. Reconciliation Commissioners
4
Commissioners 1 to 3
Procedure secret.
Name of the authority as above, the Reconciliation Committee.
Number of Committee-men Commissioners, in
places in which it is greatest, that is to say in capital
towns three: in middling towns, two: in smallest towns, one
Commissions, how locable, how located, how dislocable and dislocable
and dislocated — term of service accordingly included — not to the
present purpose material nor yet aggregate quantity and distribution
of the times of sitting in the course of the twelvemonth. Most of
procedure secret: no person present but the Commissioners a Registrar and the
parties in attendance.
5
Mode of procedure
before Reconciliation
Commissions
Under these ar Such are the circumstances, under which
an individual who has no demand to make in any case
belonging to the above list is desirous of making demand
for Judges service at the hands of any judi one of the judicatories
having cognizance of his case finds himself under the necessity
of making to the Reconciliation Commission of his district
as above application for the its permission to him to appear
before it, and its mandate for the like purpose to the individual
proposed by him to be constituted Defendant: for a small
fee paid by this would-be-plaintiff to an Officer of the Commission
If the applicants appears Exceptions excepted, the applicant
must appear and attend in person: [+] [+] otherwise the application
will not be attended to
by the Commission: and
the certificate
above mentioned
will not be granted: and so must the proposed defendant
if any attendance is on his part paid.. If Both parties
appearing appear, the Commissioner delivers his opinion approving almost of the
applicants demand, disapproving of it altogether, or adopting
from either or proposing of its own motion a middle course; recommending
as fit to be rendered by the proposed defendant a service
more or less agreeing with or different from that demanded
by the applicant: naturally a service in a greater or less degree inferior in value to that which
as above has been demanded. With the opinion of both parties
agree, no suit in the ordinary judicatory is instituted, nor therefore accordingly
for that purpose is any such certificate as above needed. If at the end of a certain
instant of time the proposed Defendant has failed to appear before the Commission
certificate of such failure is given, and thereupon, as above, the Court
is authorized to receive his suit: so if instead of failure, parties refusal.
[.] When this allowed to the road has
been to like contestation
has been laid open
[|] the applicant enters
upon it or not as he sees
best: and according
to the statements
contained in the Report,
made by authority, in
no inconsiderable proportion
the road is not entered upon
though no positive agreement has had place.
Note
(a) The case of parties more than one, on either side or each is mention
is then made only to shew that it is not out of mind: but to the present
purpose nothing turns upon it
(b) these of the exceptions specified the number is not extraneous enough to be does not present themselves as co-extensive with the demand exigency of the case
