speculation, let us come to a few plain facts:  plain<lb/>
 
though general matters of fact.</p>
<p>1.  Such is the <add>certain</add> delay, vexation and expence, and <add>coupled with</add><lb/>
at the same time uncertainty of success <del>that</del> consequent<lb/>
upon the capture of an enemy's ship, that<lb/>
in a class of cases occupying a very considerable<lb/>
extent, the capture of an enemy's vessel would be<lb/>
plainly repugnant to the manifest dictates of human<lb/>
prudence.</p>
<p>2.  Of this delay vexation and expence the far<lb/>
greater part is factitious – being the result of the <gap/><lb/>
action of those causes a catalogue of<lb/>
which may been seen in the work entitled Scotch Reform<lb/>
<add>lately</add> published by M<hi rend="superscript">r</hi> Bentham.</p>
<p>3.  The uncertainty as well as a large portion of<lb/>
the delay vexation and expence has <add>in part</add> for its excuse the<lb/>
shape in which the evidence is collected and received:<lb/>
a shape the unfitness of which to the purpose of extracting<lb/>
the <unclear>tricks</unclear> of the case is manifest to every eye<lb/>
too manifest to find <add>even</add> any learned <del><gap/></del> hand or lawyer<lb/>
hardy enough to deny it – a shape to the exclusion<lb/>
of which Jury trial is indebted for <del>an</del> at least one half<lb/>

Parly Reform Sinecures

Turning aside from dry and Waving all such thorny and at the same time parlous
speculation, let us come to a few plain facts: plain
though general matters of fact.

1. Such is the certain delay, vexation and expence, and coupled with
at the same time uncertainty of success that consequent
upon the capture of an enemy's ship, that
in a class of cases occupying a very considerable
extent, the capture of an enemy's vessel would be
plainly repugnant to the manifest dictates of human
prudence.
