Review of Humphreys

H.s Deficiencies
§ H.s Introduction — its
Properties desirable
and imperfections
in a Code
J.B.'s to
H'.s Deficiencies — Corrigenda
Agenda — Supplemada.

☞ To be inserted in front of Agenda?

1
All comprehensive Properties desirable in a Code
1. Appropriate aptitude as to
a Matter.
2. Cognoscibility, as to
Form.

[Appropriate] Aptitude and cognoscibility — in into these three this
words expression may be condensed seen the qualities requisite and sufficient
on in the part of a body of law: [aptitude with reference to the
collation generation of maximum of happiness in so far as depended
upon the covering given to that part of the field the part travelled
over of the universal field travelled over taken in hand by the order in question;
]
aptitude being a term word
of reference [aptitude understand object of reference
with reference to] the production
procurement of the maximum
of happiness produced by
labour bestowed in that the part
in question then occupied of the field of
law.

Appropriate aptitude
is conduciveness to the
maximum of happiness

cognoscibility with as to the provision thus accordingly made for the attainment
of that end — cognoscibility through the labors necessary for giving
existence to it is so small in comparison of that necessary for the
giving existence to the aptitude is not less necessary to the attainment
of the common end: for only in proportion as it is
known can the provision so made be of any the smallest can from this any more than from any other instrument of good can benefit
in any shape be reaped.

use: [suppose a mass of gold at the an unfathomable depth beneath the co existence with the ocean suppose it lying
ocea surface what would be the virtue of it?]

2
H. looks to these
properties, but neither
methodizes nor denominates
them.
Examples.

Of the unprecedented clearness and comprehensiveness of the views
taken by Mr Humphreys of that part of the field of law which he
has taken in hand, his work the five pages of his introduction
afford present the most incontestable proof: seldom indeed has so large a quantity
of new and valuable instruction been condensed into so small a space.
In appropriate aptitude the above two phrases may be seen the expression of the two
distinguishable objects to the encompassing of which his the masterly
hand has been directed: yet neither at the same time so it is that neither in those
same pages neither these phrases nor the equivalent of them are to be
found.

p.3 "Characters Institution" "impersonally demanded" (but why?)
that those characters "be well defined direct and well defined" ...
(good: but why?) "free from their testament distinction" the ... good but why?
"that possessions be kept distinct... good: by why? — In a word
in this way are strung together indications of distinguishable services, about ten
or number, desirable at the hands of a Code of law applying itself top the
part of the field. Still however the universally applicable
question bono sin without an answer.
an attempt to provide
it with an answer
may be seen in the
above two phrases.
insufficient without explanation,
yet after
explanation, their usefulness in the character of memento to the purpose of reminiscence will it is believed be found not exposed unexposed to dispute.
