Guardianship is where to the prejudice of the interest<lb/>

of the Ward that the power attached to the Guardianship<lb/>

<p>Expositive</p>
<p>Of this offence the creation is <add>considered</add> necessary by reason<lb/>
of the <del><gap/></del> magnitude of the evil which is <add>would be</add> capable of<lb/>
having place if no remedy in any shape were<lb/>
provided.</p>
<p>For yet without <del>the <gap/></del> <add>some explanation such as that which is</add> limitation applied by<lb/>
the above words can any proper definition of it be<lb/>
framed.  Take away the limitation afforded <add>created</add> by this <add>that</add> explanation,<lb/>
any Ward <del>may</del> might at pleasure be<lb/>
taken out of the hands of the Guardian <add>at pleasure</add> by the Judge.<lb/>
For suppose that in any respect the concerns of the<lb/>
Ward might in the opinion of the Judge have in any<lb/>
instance been better managed than in that same instance<lb/>
they were, <add>in that same opinion, <del><gap/></del> been</add> here in <del><gap/></del> one sense have in a relative <add>comparative</add><lb/>
sense, mismanagement has had place.</p>

Penal Code.Offences against Reputation Condition

Considered in the character of an offence requiring
legal remedy at the hands of law justice Mismanagement of
Guardianship is where to the prejudice of the interest
of the Ward either in respect of person, reputation
property or condition in life such evil has been produced
or is in danger likely to be produced in
such sort and degree that it may be for the interest
of the Ward that the power attached to the Guardianship
should be, wholly or in part, extinct(1) or transferred
into other hands.

Expositive

Of this offence the creation is considered necessary by reason

having place if no remedy in any shape were
provided.
