Instructional.
Requisite to be had in mind, during the reading
or recollection, of every part, of the field of text of every part
of the body of law of which this is the commencement, is
the instructional matter which here follows –
Here begin certain considerations and instructions which on all occasions,
it will at all times be needful to the person, whoever he be he who he
may is, to have in view.
Not excepted on this occasion, are even the legislators
of any portion of time future. By no length of time, by
no such increase of knowledge and maturity of judgement –
say in one word wisdom, – as it is in the nature of experience
to produce, that the needfulness or need and usefulness, of this
same instructional matter be superseded: seeing that at
all times, forgetfulness, oversight, unadvisedness inadvertency, are imperfections,
to which the exemplification of human nature will at all times remain exposed.
On this occasion, in two several characters are the
members of the community borne in view – namely a set of
subject citizens, and in that of legislators. Not in view On this occasion in
giving expression to the instructional matter which here
follows, taken into and kept in consideration is the selection of citizen subjects for the purpose of their being informed
of it; of legislators, for the purpose of their being reminded
of it.
Now then as to the language which on this occasion is employed.
Language is for ideas of all sorts the instrument of communication
between man and man: as also of fixation in
the minds of each.
Pregnant with evil in all its shapes are the imperfections
of which language is susceptible.
Of the number of these imperfections are obscenity,
ambiguity, and indistinctness: – indistinctness or say undistinguishedness,
undividedness unpreparedness unseparatedness as between one
part and another, of the subject matter in question, the subject matter, the parts
of which require, for any purpose, to be distinguished.
Of all these several undesirable qualities the absence is designated by the word
clearness: in such sort that where this word is employed, the absence of these several imperfections
one or more or all of them, being will be understood to be meant by it.
